State disability funds going broke, and going away

JEFFERSON CITY, Mo. (AP) ? With hundreds of thousands of wounded veterans looking for work after World War II, many states offered businesses an incentive to hire the returning heroes. They created special disability funds to help pay the tab should a soldier with a missing arm or eye suffer a second, debilitating injury in a private-sector job.

Over the ensuing decades, those disability funds provided aid not to only veterans, but to thousands of others with pre-existing ailments who slipped and fell, twisted their backs or blew out their knees while at work.

But as a new generation of wounded warriors returns from Iraq and Afghanistan, about 20 states have shut down their special disability funds because of rising costs and others are teetering on insolvency, tearing holes in the safety net the funds were intended to provide.

Today, the federal government and some states are offering tax breaks to encourage businesses to hire returning veterans. But more than 675,000 veterans from Iraq and Afghanistan have reported disabilities, and they are having a harder time getting jobs than their able-bodied, private-sector counterparts, said David Autry, a spokesman for Disabled American Veterans.

"We understand states are strapped for cash, thanks to the economy," Autry said. But "it would be a shame to just let these funds disappear." The unemployment rate for veterans injured in Iraq and Afghanistan is 12.1 percent, compared with 9.5 percent for those without disabilities.

Since the recession, many businesses are cautious about extra costs related to employees, according to Chamber of Commerce officials.

"If you talk to businesses, they are more hesitant in making any type of investment at this point, including the hiring of people," said Missouri chamber spokeswoman Karen Buschmann.

The "second injury funds" are meant to encourage the hiring of disabled workers by limiting the financial risk to businesses. If an employee who is partially disabled suffers an on-the-job injury that further impairs his or her ability to work, the second injury fund covers the workers' compensation benefits for that new injury. Without such funds, businesses are left to bear the full cost through their workers' compensation insurance. Although businesses pay into the second injury fund, the tab may be less than the increase in their workers' compensation premiums would be.

A little over half the states still have second injury funds, but rising costs have contributed to the closure of numerous others over the past two decades.

South Carolina's Second Injury Fund, which is due to be phased out by next year, stopped considering claims from injuries that happened after June 2008 because of rising losses that resulted in surcharges to employers and insurers of nearly $200 million annually. New York, which created the nation's first second-injury fund 1916, closed the fund to all new claims in July 2010 when its outstanding liabilities topped $18 billion, according to a report by Workers Compensation Research Institute. New Jersey's has been plagued by cash-flow problems.

Missouri's Second Injury Fund is on the verge of insolvency. Last year, the fund collected $43 million from businesses while its obligations increased to $77 million. To cope with a growing shortfall, Attorney General Chris Koster quit settling cases in late 2009, forcing them to drag out through a hearing process. He laid off about one-third of the attorneys who defend the fund. And last year, he quit paying new awards for permanent, total disability cases.

The state now owes about $15 million to more than 190 people who were awarded benefits in the past year.

"The fund is spiraling out of fiscal control," said Koster, a Democrat, who wants the fund to either be abolished or revamped with a new funding mechanism.

Oklahoma was in a similar situation about a decade ago when it closed its second-injury fund to new claims. But it later adopted a new flexible surcharge and reinstated its fund in 2005.

Critics of second injury funds contend they have outlived their purpose and shift costs to small businesses that may never benefit from the funds. The American with Disabilities Act provides greater legal protections to workers than existed during the World War II era. And today's veterans also have better access to federal health care benefits, said Jon Gelman, a New Jersey attorney whose has specialized in representing plaintiffs in workers' compensation and occupational disease cases.

"If you take away the second injury fund, it may not be missed at this point, because the reasons aren't as valid to have it as in the past," Gelman said.

But the Missouri Chamber of Commerce and Industry contends the funds still provide necessary protection to both employers and workers ? especially in a slowly recovering economy.

Army veteran Valerie Brown, 34, knows how difficult it can be for the current generation of disabled veterans to find jobs. After two tours of duty in Iraq, Brown said she was diagnosed as 60 percent disabled from post-traumatic stress disorder and hearing loss. She searched for four months before landing an entry level job that she found so frustrating she quit. So she enrolled in college and is now re-starting her hunt for work.

"Coming forward and actually telling people you have PTSD is very, very risky," said Brown, an Oklahoma native who now lives in Independence, Mo.

Brown said injured veterans need help persuading employers to give them a chance.

"If something happened at work, say the person has a seizure or something and hits her head on the desk or gets injured, that would make such a huge difference," she said.

Among the veterans receiving weekly payments from the Missouri fund is John Cleeton, who broke his ankle while serving with the Army in Vietnam and then suffered a variety of on-the-job injuries as a Kansas City police officer. He fears it would be financially devastating for people who suffer future work-related injuries if the Second Injury Fund were to be eliminated.

"It helps people ?it keeps them from having to resort to begging at the corners," Cleeton said

State disability funds have run into financial troubles for a variety of reasons. As more people have become eligible for payments ? most of them civilians injured on the job, not veterans ? the dollar value of the awards also has grown because of the rising cost of medical care, and the assessments charged to businesses have not kept pace.

Missouri is an extreme example. A 2005 law placed a 3 percent cap on the Second Injury Fund surcharge on businesses' workers compensation premiums, instead of allowing the rate to fluctuate to meet expenses. The law was backed by various business associations, who now are supporting legislation to raise the surcharge cap to 4.5 percent, or perhaps as much 6 percent. But some attorneys who represent the disabled say that won't be enough to save the fund.

"It is the business community that created this shortfall," said St. Louis attorney Mark Moreland, who is on the board of governors for the Missouri Association of Trial Attorneys. "It is time that we stop letting them be dead-beat dads to the disabled."

A group of biologists from Denmark and the US led by Jakob Christensen-Dalsgaard, University of Southern Denmark, and Catherine Carr, University of Maryland, have shown that the turtle ear is specialized for underwater hearing. The new discovery is published in Proceedings of the Royal Society B March 21st , Special features of the turtle ear ? a large, air-filled middle ear and a movable tympanic disk increase its sensitivity for underwater sound. Laser measurements of disk vibrations in response to underwater sound show up to 100-fold larger vibrations of the disk than the surrounding water, most likely because the air volume resonates in an underwater sound field and drives the tympanic disk.

The tympanic middle ear is often seen as an adaptation to hearing in air, but the turtle tympanic ear is an anomaly here, because turtles are generally 100-fold less sensitive than other animals with eardrums, like mammals, birds and reptiles.

However, turtles are amphibious animals, and anatomical and biophysical studies by a group of biologists from Denmark and the US have shown that the ear of the red-eared slider is specialized for underwater rather than airborne sound.

CT scans, laser measurements from the ear under water and auditory evoked responses showed that the turtle ear was more sensitive for underwater than for airborne sound. The sensitivity is caused by the air filled middle ear. Resonance in the air cavity lined by the tympanic disc drives the disc and amplifies its vibrations up to 100 fold under water.

What the turtle is using its sensitive underwater hearing for is unknown. However, the sensitive hearing can be used for prey capture, predator avoidance and navigation under water. An alternative possibility is that turtles communicate by underwater sound. Underwater sound communication is unknown in the red-eared slider, but has recently been described in two other turtle species.

One demo they showed me involved a gift card where a user scans the bar code associated with it. At this point a unique URL is passed to a browser and opened on the mobile device allowing a consumer to check balance information, make a payment and connect their cell phone to the card. Then a consumer can opt in for marketing information and can further text message to get a response with balance information on the card. Then they can scan a code on a product to have the amount debited from the card. In this manner the cell phone becomes the card meaning the card doesn?t need to be used again.

It is worth mentioning that Neustar handles the messaging and communications in the above demo.

The company has covered North America with carrier partnerships and recently Telus has signed up to the platform enabling developers to integrate the best of Neustar APIs with those from Telus allowing such things as mobile payments and messaging.

Neustar also provides communications for enterprises ? for example their Mobile Enterprise Services solution allows an HR department to communicate rapidly with workers not only via SMS but via email and desktop solutions. This solution is powered by the company?s Text Everywhere service.

They also have a Geofence solution enabling marketing based upon location. Partner ZOS enables the company to provide its customers the ability to provide messages and offers when users are near specific locations.

Neustar has a storied history as a trusted third party providing SMS short codes, DNS look ups LNP information and more. They believe this position in the market allows them to be the optimal partner at a time when privacy and consent are becoming so important.

Last year the company purchased TARGUSInfo and is now able to correlate anonymized data from 200 independent databases allowing an app developer for example to see if a cell phone user is likely to be able to purchase a luxury car, etc.

A handful of big-name players within the cupcake industry are betting that America?s cupcake obsession will continue as they embark upon ambitious expansion plans.

Recent data back up this confectionery gamble ? but with a caveat. Growth within the cake decoration stores industry is expected to slow to 3.7 percent annually over the next five years, according to an October 2011 report from research firm IBISWorld. This forecast represents a dip from the 4.9 percent growth that the industry was predicted to have enjoyed during the past five years.

?The market is becoming more and more saturated as cupcake stores open, but ones like Crumbs?or Sprinkles that have a more recognizable brand can succeed,? said Mary Nanfelt, the report?s author.

Several high-profile cupcake brands are in the midst of expansions from Boston to Beirut.

Magnolia Bakery ? one of the most recognizable cupcake shops, made famous by the hit TV show "Sex and the City" ? aims to add 200 stores within the next five years, said Bobbie Lloyd, the company?s operating partner and president.?

One franchise location opened in February 2010 in Dubai while another is currently under construction in Doha, Qatar ? thousands of miles from the company?s original New York City location.

?We?re working on agreements in other places such as Russia, Japan, Morocco, Turkey and China, so that?s the world-domination factor, which is always our internal cupcake joke,? Lloyd said.

?The cupcake?s reputation as a small luxury at an affordable price has fueled growth within the bakery industry.

??I think that when times are tough, people can still afford $2.75 for a cupcake,? said Katherine Kallinis, one half of the sister duo who founded Georgetown Cupcake in 2008. ?It?s a luxury that everyone can afford ? it?s not going to break the bank.?

?Kallinis and her sister Sophie LaMontagne are the stars of TLC's "DC Cupcakes," which is currently in its third season. In February, they opened the company?s third location, in New York City?s SoHo neighborhood. Another location is set to open in Boston in May.

Although the pair eventually wants to expand their business to the major cities and open a location on the West Coast, they do not want to franchise their business. Instead, they plan to keep their locations privately owned.

?Our approach is that we want to keep Georgetown Cupcake special, and there?s a way to do that without being on every street corner,? LaMontagne said.

Although franchising is becoming more popular, aspiring bakers can still prosper if they choose to launch their own concepts, Nanfelt said.

??People like to buy local now and support the small businesses,? she said about franchising. ?It?s important for the larger cupcake stores, but small bakeries can survive if they create a loyal clientele.?

?No company currently dominates the highly fragmented U.S. cupcake business, but Crumbs Bake Shop?is the largest retailer of cupcakes. The company went public at the end of June, but its shares have since fallen sharply.

?Still, the company plans to expand to 200 locations from its current 50 by the end of 2014. Although Crumbs plans to expand, the company said in its in fourth-quarter earnings report that it may close some existing locations.

?In 2012, the company has already opened?two stores, is in the construction phase with?two other locations, and anticipates opening between?five and?seven mall-based stores within the Boston to Washington, D.C. corridor,? the report said. ?In addition, the company may also selectively look to terminate some existing leases as part of its efforts to strengthen its overall portfolio.?

As cupcake stores sprinkle their locations across the U.S., Nanfelt said they face a number of challenges. In recent years, volatile commodity prices for flour, sugar and milk have dented bakery profits. This year, egg prices are expected to increase 2.9 percent, while sugar prices? are expected to increase 6.4 percent and milk 1.6 percent, the USDA forecasts.

Consumers are also becoming more health conscious, moving away from sweets while bakeries are experiencing stiffer competition from grocery stores and mass merchandisers, such as Costco, that sell baked goods at a lower price.

But the biggest challenge for the cupcake may also be the key to its current success.

?It depends on the trend of cupcakes and if it will remain popular with consumers; that?s unpredictable,? Nanfelt said. ?The trend could easily change. Food trends change often.?

Adriana Lara, a mother in Hutto, Texas, is not able to work because her 5-year old son Joshua has autism. Lara must stay home to give Joshua the care he needs, and to drive him to his therapy sessions five days a week.

"It's just impossible for me to be able to hold a job and do all these things with Josh," Lara, 31, said. The family depends on the salary of Lara's husband, a psychologist at a Veteran's Affairs hospital.

Joshua's therapies, including speech, music and occupational therapy, cost about $5,000 a month. Eighty-five percent of the cost is currently covered by a government grant, but the grant will run out this summer, and the family's insurance policy won't cover Joshua's therapies, Lara said.

"We don?t know how we're going to afford it," Lara said. While public schools offer autism therapies, Joshua's school does not offer the type of intensive therapies he needs, Lara said. For instance, the therapies provided by Joshua's school are not one-on-one, Lara said.

A new study highlights the unique financial burden faced by families of children with autism, like Lara's. The burden is particularly significant for mothers, the study finds.

On average, mothers of autistic children earn $14,755 less per year than mothers of healthy children, and $7,189 less per year than mothers of children with other health conditions (such as asthma and ADHD) that limit their ability to engage in childhood activities, according to the study.

Despite the fact that they tend to have completed more years of education, mothers of autistic children are 6 percent less likely to be employed, and they work on average 7 hours less weekly than mothers of healthy children, the researchers say.

"We don't think that autism creates more of a strain on the family per se than other chronic conditions of childhood," said study researcher David Mandell, associate professor of psychiatry and pediatrics at the University of Pennsylvania School of Medicine. "I think the reason these mothers are leaving the workforce is because the service system for children with autism is so fragmented," Mandell said.

Health care and workplace policies need to recognize the full impact of autism, and alleviate costs for the families with greatest needs, the researchers concluded, writing in the March 19 issue of the journal Pediatrics.

Higher bills, lower salaries

About 1 in 110 children in the United States have an autism spectrum disorder, a developmental disability that can cause language delays, impaired communication skills and social challenges, according to the Centers for Disease Control and Prevention.

The new study results are based on yearly surveys of U.S. households conducted between 2002 and 2008. The study included 64,349 families with healthy children, 2,921 families of children with other health limitations and 261 families of children with autism.

While fathers' salaries, by themselves, were not affected by having a child with autism, total family income was, the study showed. On average, families with autistic children earned $17,763 less than families with healthy children, and $10,416 less than families with children with other health limitations.

As Lara's story shows, having a child with autism may limit the parents' abilities to work because these children require more care. Finding quality, specialized childcare for autistic children may be difficult and costly, the researchers say.

"A traditional daycare setting really is really not conducive," for children with autism to thrive, said Carolyn Price, whose 7-year old son has autism. Autistic children are very sensitive to sights and sounds, and may be overwhelmed at a day care, Price said.

When Price's son was in daycare ? before he was diagnosed with autism ? he would bite other children because he couldn't cope with the environment, Price said. In addition, autistic children need one-on-one interaction that is generally not feasible at day care, Price said.

When Price's son, also named Joshua, was young and had to be at home, she and her husband felt uncomfortable having anyone beside themselves or close friends look after him.

"It's really challenging when you have a child with special needs, to really turn that responsibility over to someone else and feel like they are getting the best care," Price said. Price's husband Joel still works only part time, so he can drive his son to therapy sessions.

Financial support

Children with autism need to be immersed in their therapies in order to benefit, Price said. Providing therapy one day a week, when a child needs five sessions, won't have the same impact, Price said.

In 2010, Price and her husband started a non-profit organization called Imagine a Way to provide financial assistance to families with autistic children. The organization focuses trying to provide funds to support for children for two years.

While other nonprofits and government subsidies offer support to families of children with autism, it's often comes in the form of a little bit at a time, Price said.

"There's a recognized need for it, I just don't think there's a consolidated organization like Autism Speaks, that?s able to do something on a major scale," Price said. While any source of funding is valuable, "For the magnitude of what these kids need, a little bit is just not enough," Price said.

Scientists discover drug side effects, interactions using new computer algorithm

ScienceDaily (Mar. 14, 2012) ? A week ago, you started a new prescription medication for acne. Today, you feel dizzy and short of breath and have difficulty concentrating. Your symptoms are not listed in the package insert as possible side effects of the drug, but why else would you be feeling so odd?

Unfortunately, there's no easy answer. Clinical trials are designed to show that a drug is safe and effective. But even the largest trials can't identify irksome or even dangerous side effects experienced by only a tiny proportion of those people taking the drug. They also aren't designed to study how drugs interact with one another in the human body -- a consideration that becomes increasingly important as people age and their medicine cabinets begin to overflow.

Now researchers at the Stanford University School of Medicine have devised a computer algorithm that enabled them to swiftly sift through millions of reports to the U.S. Food and Drug Administration by patients and their physicians and identify "true" drug side effects. The method also worked to identify previously unsuspected interactions between pairs of drugs, most notably that antidepressants called SSRIs interact with a common blood pressure medication to significantly increase the risk of a potentially deadly heart condition.

The research, which includes a list detailing several dozen of the most prominent drug interactions, was published March 14 in Science Translational Medicine. Russ Altman, MD, PhD, a professor of bioengineering, of genetics and of medicine at Stanford, is the senior author of the research, and graduate student Nicholas Tatonetti is the first author.

"The average 70-year-old is taking seven different prescription medications," said Altman. "The FDA has a database for patients and physicians to report possible adverse drug events, but it's very difficult to uncover true side effects because people vary in their medical histories, conditions and drug regimens, as well as in age, gender and environment. Some researchers have gone so far as to say, 'No one will ever get useful information out of all of this data.'"

Although the FDA has its Adverse Event Reporting System for doctors, patients and drug manufacturers to use after the agency has approved a drug, many of the more than 4 million reports in the database are little more than anecdotal -- there's no way to tell whether the fever, rash, dizziness, seizure or other unwanted reaction was a true side effect of the drug, a result of a combination of medications or even a simple fluke of circumstance (maybe the patient had a cold or other undiagnosed medical condition at the time of the event).

Tatonetti developed a way to run a kind of case control study within the data, matching up groups of people who were as alike as possible, with the exception of one drug variable -- say, a hypertension medication. If significantly more of the people on the drug reported an adverse event, such as headaches or vomiting, than did those who were not taking the drug, it is likely that the medication was indeed the culprit. A similar method can be used to analyze the effects of pairs of drugs.

"It sounds obvious, but it's a nifty statistical way to eliminate bias," said Altman. "And we found that the more things you can match between the groups, like other drugs the people have in common, the more likely you are to also unintentionally match for variables you may not have even thought about but that may affect the result."

If they are on an antidepressant, you know they are more likely to be female, explained Tatonetti. If they're also taking a statin, you know they may have a high-fat diet, he added. If they've been prescribed medication for an enlarged prostate, you know they are male. "By matching up as many of these variables as possible, we're also controlling for gender, age, diet and many other things that may not be directly included in the FDA database," he said. "This increases the predictive power of the technique."

Tatonetti and Altman used the technique on the database from the FDA's Adverse Event Reporting System to discover previously unidentified side effects and drug interactions. They then tested their predictions by analyzing the electronic health records of patients at Stanford Hospital & Clinics. They confirmed that 47 new drug interactions identified in the AERS study held true when analyzing the records of "real" patients. In particular, patients receiving both an SSRI and a class of blood pressure medication called thiazides were more likely (9.3 percent) to exhibit prolonged QT intervals on an electrocardiogram than patients taking either medication alone (4.8 percent vs. 6.5 percent, respectively). Prolonged QT intervals are associated with increased incidence of spontaneous arrhythmias and sudden cardiac death.

The researchers have created two publicly available databases of their work, named OFFSIDES and TWOSIDES, respectively.

So far the OFFSIDES database includes an average of 329 new adverse events for each of the 1,332 drugs included in the system. (The average number of adverse events listed on a drug's package insert is 69.) The TWOSIDES database identifies 1,301 adverse events, resulting from an analysis of 59,220 pairs of drugs that cannot be clearly assigned to either drug alone.

"This is a testament to the value of huge data sets," said Altman. "They allow us to throw out a lot of cases. When you start with millions of pieces of information, you can be pretty rigorous about weeding out those that don't match. And if you can arrive at even just a few hundred well-matched cases, that can give a good statistical comparison."

In addition to helping physicians to better tailor prescriptions for their patients, the database can also further drug discovery efforts by identifying medications with similar side effects. Previous research has shown that drugs with similar side effects may affect the same biological pathway, and may be useful for more than one clinical indication. For example, diazepam (marketed as Valium) and zolpidem (marketed as Ambien) share similar side effects and act on seven of the same protein targets, even though they're usually prescribed for different conditions.

"We're interested in understanding the biological effects of drugs in the body," said Tatonetti. "Can we connect these population-level outcomes to particular biological pathways? If so, we can learn a lot more about how drugs are acting in the body, and this in turn can help with drug discovery and in predicting possible future adverse events."

"This kind of pharmacoepidemiology is becoming increasingly important to understand how drugs work in the body," said Altman. "It can help a physician better and more safely tailor drug prescriptions to patients. It can also drive drug development and discovery by identifying shared biological pathways and targets among drugs with similar side effects."

Graduate student Patrick Ye and medical student Roxana Daneshjou also participated in the study. The research was funded by the U.S. National Library of Medicine, the Department of Energy, the Howard Hughes Medical Institute, the National Institutes of Health, the Bruce E. and Doris A. Nelson Fellowship Fund and the National Institute of General Medical Sciences.

Romney: Obama Trying to Blame GOP Candidates for High Gas Prices

KIRKWOOD, Missouri - Mitt Romney said President Obama's assertion that concerns about war between Iran and Israel in the Middle East are to blame for rising gas prices is a "pretty tough one to follow" and suggested the president is trying to deflect blame to his? GOP rivals.

In an interview with ABC affiliate KVUE Monday, the president said concern about the Middle East and war there contributes to escalating gas prices.

"In the short term, the biggest driver is what's happening in the Middle East and the concerns over war there. A couple of weeks ago I said, 'Let's stop with the loose talk about war," Obama said.

Romney said president was trying to pin blame on Republicans for gas prices.

"He said [the reason we have high gasoline prices] is because republican presidential candidates are talking in a very muscular way about Iran and their nuclear program," said Romney, speaking at an outdoor event outside St. Louis. "Now that's a pretty tough one to follow, alright."

"And frankly it's disappointing to have the President of the United States take a serious foreign policy issue which is Iran, the state sponsor of terror in the world becoming nuclear, and trying to turn that into saying we're somehow responsible for high gasoline prices in this country," said Romney.

Obama reiterated the talking point about "loose talk" of war, the Middle East and gas prices several times on Monday during a series of interviews in Washington, D.C., with local TV stations from throughout the country.

"The biggest driver of these high gas prices is speculation about possible war in the middle east which is why we've been trying to reduce some of the loose talk about why war there," Obama said during a separate interview with ABC's Orlando, Fla., affiliate WFTV.

Romney said that Obama is simply deflecting responsibility when it comes to gas prices.

"The president is looking around for someone to blame," said Romney. "You know, it's, it seems to be part of his nature. He's out of ideas, he's out of excuses, and in 2012 we're going to get him out of office. That's got to get done."

"But he said something, I think it was yesterday, he said the reason we have high gasoline prices is - and then he was seeking around. What could it be? What could it be?" said Romney. "Now I have some suggestions for him. Maybe it's related to the fact that you stopped drilling in the Gulf. Maybe it's related to the fact, Mr. President, that you weren't out drilling in ANWR. Maybe it's related to the fact that you said we couldn't get a pipeline in from Canada known as Keystone. Those things affect gasoline prices, long-term."

The president made the comment warning against "loose talk"? of war before a meeting of the American Israeli Public Affairs Committee, a pro-Israel lobbying group. During a press conference two days later, as Republicans in 10 states were voting in their primaries, he was asked about the need for debate on tension between Israel, the U.S. and Iran.

"Well, I think there's no doubt that those who are suggesting, or proposing, or beating the drums of war should explain clearly to the American people what they think the costs and benefits would be," Obama said during that March 6th press conference.
